The Department of Government Services (DGS) was established on 1 January 2023 to improve everyone's experience of doing business and interacting with the Victorian government. We bring important day-to-day services together in one department to make things easy and seamless for Victorians and businesses. We are doing this by connecting and digitising our systems and platforms across state and local government as well as streamlining our corporate and procurement services.  
 

About the role

Senior Solicitors within the Consumer Affairs Victoria (CAV) Legal Team provide specialist legal support across CAV, including to the Regulatory Services Division, Renting and Underquoting Taskforces and to the Director of CAV. Specifically, legal support is provided through the provisioning of specialist legal advice to investigators during the course of investigations and direct carriage of litigation matters across civil, criminal and administrative jurisdictions. Senior Solicitors are also expected to appear as solicitor advocates in the Victorian Civil and Administrative Tribunal, Magistrates' Court of Victoria, Supreme Court and Federal Court. 

The position also takes a leadership role in project teams conducting sensitive and complex investigations and other compliance and enforcement activities.

Reporting to the General Manager, Legal Services, Senior Solicitors play a key role in successfully enforcing Australian and Victorian consumer law

Key accountabilities 

  • Assist CAV Legal with the provision of legal services to the Regulatory Services Division.
  • Appear before superior Victorian Courts and Tribunals on behalf of the Director of Consumer Affairs Victoria.
  • Conduct proceedings arising out of contraventions of legislation administered by Consumer Affairs Victoria. 
  • Provide accurate, timely, high level legal analysis, advice, comment and opinion in respect of legislation administered by CAV.
  • As required, manage and lead project teams responsible for conducting sensitive, complex investigations and other compliance and enforcement activities including legal policy and processes.
  • Produce authoritative advice and provide assistance to staff across Regulatory Services Division in relation to the preparation and conduct of investigations.
  • Identifies issues in common for one or more clients or stakeholders and uses them to build mutually beneficial partnerships

Mandatory requirements

  • To be admitted to practice as an Australian lawyer and eligible to hold an unconditional Victorian practising certificate. You will be asked to provide evidence of this requirement.

Technical expertise

  • Demonstrated experience in prosecuting/litigating complex and sensitive criminal and civil law cases in a range of jurisdictions.
  • Experience managing legal work in a complex environment including liaison with investigators and other state and federal bodies.
  • Experience in supporting investigations and in the preparation of and appearances in civil and criminal litigation in complex matters.
  • Experience as a solicitor advocate appearing in both criminal, civil, State and Federal jurisdictions.
  • Experience in directing legal research and demonstrated ability to develop and direct innovative responses to new and emerging issues.
