Position Details

The Prosecution Services branch forms part of Agriculture Victoria within the Department of Energy, Environment and Climate Action (DEECA). Prosecution Services provides a range of prosecution and enforcement services to internal and external regulators, primarily within the agriculture and resources portfolios of the Department.
The Solicitor Prosecutor / Senior Prosecutor is responsible for the prosecution of offences that relate to matters that include livestock welfare and cruelty, livestock disease/traceability, biosecurity, invasive species, game, mineral and earth resources, major events, Aboriginal cultural heritage, agricultural chemical standards, and plant standards. The incumbent will also undertake internal reviews of infringement notices issued by relevant regulators.
The incumbent should be a lawyer with relevant experience (Solicitor Prosecutor) or an enforcement officer (Senior Prosecutor) with demonstrated experience, knowledge, skills and ability to appear in Court as advocate with minimal supervision.
Reporting to a Senior Solicitor, the incumbent liaises closely with the operational areas of the department and provides written and oral advice on procedural, evidentiary and legal matters (subject to holding a practicing certificate).
In accordance with the department's compliance policies and other relevant policies and guidelines, the incumbent ensures that any enforcement action taken by the department is fair, proportionate and in accordance with law.
The successful applicant will work effectively as a member of a small team, enjoy flexible working arrangements, and undertake a wide variety of work.
Specialist/Technical Expertise/Qualifications
- If the applicant is a qualified lawyer, the applicant must be admitted to practice law in Victoria and must possess a current and valid Australian Practicing Certificate (or the ability to obtain one).
This is an ongoing position. The work location for this position is 8 Nicholson Street, East Melbourne (flexibility may be available) with hybrid work arrangements available.
