The role is within the Workplace and Education Law Branch, which includes the Children, Families and Education Law team (CFEL), the Negligence litigation team, and the Workplace, Discrimination and Disputes team (WDD). These roles will be within the WDD team. The Branch provides strategic legal advice and support across the Department’s portfolio in all areas of government law including privacy, FOI and administrative law. The WDD team provides legal advice in relation to discrimination, human rights and employment law and manages litigation brought against the Department.

Position Details

An exciting opportunity exists for a Senior Lawyer to join the Legal Division, within the People and Executive Services Group, Department of Education and Training.

The Legal Division leadership team comprises the Executive Director, Branch Directors and Principal Lawyers and Managers from across the Division.

Work undertaken by lawyers in this Division includes technical and complex legal analysis, legal advice, legal policy, project management and effective stakeholder engagement.

Senior Lawyers within the Division are leaders, and are accountable for their own work program but also contribute to the broader strategic plans to achieve Divisional priorities, and devise and implement improved systems and processes.

The WDD Senior Lawyer role will work closely with Principal Lawyers and Managers in providing high quality, timely legal advice on complex, high risk or sensitive duty of care matters and legal policy work to internal departmental clients, often within short timeframes, and will have strong legal skills and interest in managing requests for advice and litigation brought against the Department. The role will encompass a wide range of matters including managing significant, sensitive and high profile litigation in the Commissions, Courts and Tribunals and briefing external firms and sometimes directly briefing barristers. There is also the opportunity for advocacy and appearance work, including representing the Department in mediations and conciliations in the Fair Work Commission and Department Boards.

To support the success of the Legal Division, Senior Lawyers will identify and respond to emerging issues in litigation. The successful candidate will also have the drive to contribute to innovative policy projects and reforms to improve Department practice in key areas of legal risk. The role will require the capacity to prioritise matters and provide urgent advice where necessary. Core capabilities include excellent communication, project management and stakeholder management skills.
