Senior Investigator

The Architects Registration Board of Victoria (ARBV) is a self-funding statutory authority which has as its primary responsibilities the registration of architects and approval of architectural companies/partnerships, the regulation of the professional conduct of architects (including complaints) and the regulation of prescribed terms linked to the practice of architecture. The ARBV's Complaints and Investigations function is part of a multi-faceted, risk-based, and evidence-led program of regulatory activity. Reporting to the Principal, Legal and Regulation, the primary focus of the Senior Investigator is to manage reactive (complaints and investigations) and proactive (for example, education and monitoring) regulatory work in accordance with the legislative and regulatory framework and ARBV’s Regulatory Strategy. The ARBV is looking for a legally qualified Senior Investigator to provide the required skills, qualifications and experience to undertake compliance and investigations duties.

Position Details

 

Regulatory / Compliance 

Apply administrative law and highly developed skills to interpret and apply legislation to undertake regulatory investigations, prepare recommendations in relation to regulatory decisions, and ensure compliance process outcomes are accurately recorded and effectively communicated, including:

  • Plan, participate in and lead investigations into possible breaches of the regulatory framework
  • Conduct interviews, prepare statements and affidavits and use monitoring and investigation powers to identify and collect evidential material
  • Collect, secure and manage evidential material and confidential information gathered during investigations and other compliance activities
  • Produce high quality investigation reports and briefs of evidence to support recommended administrative action including compliance and enforcement decisions
  • Apply a risk-based approach to regulation to ensure that regulatory decisions are logical, consistent, effective in securing compliance with the regulatory framework, defensible and made efficiently
  • Ensure ARBV's regulatory response is proportionate with the overall risk of actual or possible non-compliance with the regulatory framework
  •  Develop and implement a framework for the collection, collation, analysis and reporting of complaints and compliance issues proactively identified, enabling analysis of trends, identification of emerging issues and risks
  • Develop focused strategies that address the most significant existing and emerging compliance issues in tandem with developing improved data analytics to better identify emerging trends and targeting of non-compliance of most need and effect
  • Participate in the delivery of education opportunities to inform and educate architects the public about the ARBV's functions and the requirements of relevant legislation and regulations

 

Best Practice / Quality Control 

  • Assist in the development and implementation of the Complaints Handling Procedures and ongoing improvements to the Operations Manual
  • Ensure the quality and accuracy of output from the team ensuring all reports are written in a professional manner cognisant of the broader regulatory environment and identifying areas for optimisation and continuous improvement in existing investigative methods
  • Provide support to the Principal, Legal and Regulation on proposed legislative reform
  • Coordinate training on regulatory compliance strategies and processes for staff and Board members

 

Qualifications and Experience 

Tertiary qualifications (LLB minimum) in Law and will hold or be eligible to hold a practising certificate in the State of Victoria

Demonstrated understanding of current administrative law principles and the capacity to apply these to sound administrative decision making

High level knowledge and experience of Tribunal processes, rules of evidence and adherence to ethical standards of responsibility required with proven expertise in analysing and reviewing complex technical information and providing critical advice on investigations issues and legal matters

 

Employment Eligibility

• Applicants must be an Australian Citizen, Permanent Resident or hold a valid work permit or visa
• Recipients of Victorian Public Service (VPS) voluntary departure packages should note that re-employment restrictions apply
• External applicants will be subject to a probation period of six months
• Employment will be subject to a Federal Police check to the satisfaction of ARBV
